Terms of Service

These terms outline how Sky Fusion Technologies delivers automation services and the responsibilities shared between SFT and our customers.

1. Acceptance of Terms

By accessing any Sky Fusion Technologies ("SFT") product, sandbox environment, or flight operation, you agree to these Terms of Service, our Privacy Policy, and any applicable service order. If you are acting on behalf of an organization, you confirm that you have authority to bind it to these terms.

2. Services

SFT provides SaaS tools, AI automation, and UAV infrastructure designed for compliant aerial logistics. Service availability depends on your subscription tier, regulatory approvals, and environmental constraints. We may update features to improve safety or to meet legal requirements.

3. Eligibility & Account Security

Authorized users must maintain accurate contact information, safeguard credentials, and comply with regional aviation standards. You must notify SFT immediately of unauthorized account access or drone incidents. We may suspend access when safety or compliance is at risk.

4. Acceptable Use

You may not reverse engineer, interfere with flight systems, or use SFT services for unlawful payloads, geographies, or surveillance. Payload operations must adhere to DGCA guidelines, local airspace advisories, and mission-specific restrictions communicated by SFT.

5. Customer Obligations

Your organization is responsible for procuring necessary licenses, ensuring trained operators supervise missions, and storing local backup copies of regulatory reports. You must cooperate with SFT during incident investigations and maintain insurance coverage where mandated.

6. Fees & Payment

Invoices are due within the payment window stated on each order. Late payments may incur financing charges at the maximum rate permitted by law. We may suspend services for overdue accounts, but we will provide reasonable notice before termination.

7. Intellectual Property

SFT retains all rights to our software, hardware designs, documentation, and branding. You receive a limited, non-exclusive license to use the services for internal business purposes. Feedback you provide may be used to improve SFT products without additional compensation.

8. Confidentiality

Each party must protect the other’s confidential information using reasonable safeguards. Operational flight plans, regulatory filings, and system diagrams shared by SFT remain confidential unless disclosure is required by law.

9. Warranties & Disclaimers

SFT warrants that it will deliver services with commercially reasonable care and in accordance with applicable laws. Except where prohibited, the services are provided "as is" and SFT disclaims implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

10. Liability

To the extent permitted by law, SFT’s aggregate liability arising from these terms is limited to fees paid in the preceding twelve months. Neither party is liable for indirect or consequential damages, including lost profits, mission delays, or corrupted telemetry.

11. Indemnification

You agree to indemnify and defend SFT against third-party claims arising from misuse of the services, violations of airspace regulations, or payload operations that breach local law. SFT will indemnify you against claims alleging that our core platform infringes a third party’s intellectual property rights.

12. Term & Termination

Either party may terminate an order for breach if the violating party does not cure within thirty days of written notice. Upon termination, mission data available for export will remain accessible for thirty days unless earlier removal is required by regulators.

13. Governing Law

These terms are governed by the laws of India, without regard to conflict of law rules. Disputes will be resolved in Kolkata courts, except where aviation authorities mandate alternative venues.

14. Changes

We may update these terms to reflect new regulatory obligations, product capabilities, or pricing. We will provide at least thirty days’ notice for material changes. Continued use of the services after the effective date constitutes acceptance of the revised terms.
